General Terms and Conditions for Intensive University Continuing Education (uWIN) at the University of Innsbruck

in particular payment and cancellation conditions

 

1. Scope of validity

Unless expressly agreed otherwise, these General Terms and Conditions apply to all continuing education programmes offered by the University of Innsbruck as part of the Intensive University Continuing Education Programme (uWIN).

2. Registration

Registration for uWIN takes place in writing or online within the respective registration period for the uWIN formats and is binding. The number of places is limited. Registrations will be ranked according to the date of receipt - after checking the registration requirements in accordance with the uWIN programme schedule. After successful registration, participants will immediately receive a confirmation of registration by e-mail. After registration, participants will receive confirmation of enrolment and a request for payment. The contract is concluded when the confirmation of enrolment including the request for payment is sent.

A minimum number of participants is set for all uWIN formats. A uWIN format will only be realised if this number is reached (see number 6.).

3. Fee and payment conditions

The payment fee is shown separately for each uWIN format. Payment of the fee must be made in full within seven days of receipt of the payment request to the specified account of the Division for Continuing Education. Any additional services are shown in the respective description of the uWIN formats. The payment contributions are VAT-free. Participants are only entitled to take part in uWIN once the fee has been paid in full.

4. Cancellation conditions

In the event of being unable to attend, a written or online cancellation is required. From the time of registration up to four weeks before the start of the uWIN format, 25% of the payment amount and up to one week before the start 50% of the payment amount will be charged as cancellation fees, after which the entire payment amount for the respective uWIN format must be paid. This does not affect any right of cancellation under number 5. In the event of a no-show at the start of the uWIN format, the entire payment fee will be charged. A substitute participant will be accepted without additional costs if the registration requirements are met.

5. Right of withdrawal

In the case of a consumer transaction within the meaning of the Consumer Protection Act, there is a right of cancellation if participation in uWIN does not take place in connection with a leisure activity and no specific time or period for the uWIN format has yet been specified when the contract is concluded. In this case, the cancellation period is 14 days from conclusion of the contract. A cancellation form is attached to the registration confirmation, but its use is not mandatory. If uWIN formats (e.g. block courses) begin before the end of the cancellation period and are fully provided and completed before the end of the cancellation period, the participants expressly agree to the start of the uWIN format before the end of the cancellation period and confirm the loss of the right of cancellation after complete fulfilment of the contract.

6. Cancellation of university courses / courses / drop out of individual lecturers / exclusion

The University of Innsbruck reserves the right to cancel individual uWIN formats if the required minimum number of participants is not reached or if legal or official regulations do not permit their implementation. In this case, any payment already made will be refunded in full without delay. Any cancellation fee paid will also be refunded in the event of cancellation.

No refund of the payment fee will be made to participants who cancel the uWIN format prematurely for reasons within their control. The same applies to participants who are excluded from further participation due to non-compliance with essential regulations (e.g. serious or repeated violations of the house rules or good scientific practice).  Likewise, no refund of parts of the payment fee will be made if a lecturer is replaced. Refunds of parts of the payment fee are also excluded in the case of minor changes (e.g. change of date or location, partial switch to virtual lectures) that are objectively justified or if participants are unable to participate in uWIN for reasons within their sphere of influence. In the event of postponements, no compensation can be paid for expenses incurred (e.g. travel expenses, parking fees, costs for lost time) if these are not due to intent or gross negligence on the part of the University of Innsbruck or the lecturer.

7. Proof of success and confirmation of participation

At the end of a uWIN format, participants receive a certificate of attendance, provided they have fulfilled the attendance requirement of 75% specified by the Division for Continuing Education.

9. Liability

In the event of theft, loss or damage to items brought onto the premises, in particular valuables, the University of Innsbruck accepts no liability unless it is guilty of gross negligence. A repeated or serious violation of the house and usage regulations or other safety regulations of the University of Innsbruck that justify a house ban will lead to exclusion from further participation in uWIN; in this case, the payment fee will not be refunded, not even on a pro rata basis.

10. Insurances

The participants have to take care of their insurances (health, accident and liability insurance) themselves.

11. Place of jurisdiction, applicable law

The place of jurisdiction is Innsbruck. For participants who have consumer status, this is the case if they have their place of residence, habitual abode or place of employment in Innsbruck.

Austrian law shall apply exclusively to the exclusion of the conflict of law rules of private international law.

Zum Abschluss erhalten Sie am Bildschirm die Bestätigung der Anmeldung.
